Show Notes

In today's episode, Minh gives detailed insight into the NDIA (National Disability Insurance Agency) decision-making process, specifically in terms of SDA Funding and approving applicants for their needs and requests. He discusses the outcome of applications and what might occur if someone is not approved for their specific requests. Minh also covers the process that may follow if one wishes to appeal a decision made by the NDIA and how the AAT (Administrative Appeals Tribunal).

SDA is complicated and sometimes the NDIA might not give the same outcome that the Participant is seeking. When this occurs, it may be appropriate to ask the NDIA to review an initial SDA decision by providing additional, or clarifying existing, information.

Excerpt from May 2022 Housing Hub report:
"In order to understand and engage with the SDA decision-making and appeals process, the Housing Hub and the Public Interest Advocacy Centre (PIAC) commenced a collaborative project in mid-2021, providing legal help to participants seeking reviews of NDIA decisions about SDA funding at the Administrative Appeals Tribunal (AAT). This report presents early findings from this project, with the aims of:

1. Documenting decisions and processing times for requests for SDA funding made by participants to the NDIA, based on Housing Hub data.
2. Exploring systemic problems within the NDIA’s decision-making process that PIAC has identified during the project and proposing solutions".
